Restrictions on Use
a. Residences: Manufactured (double-wide), modular
or stick-built homes may be placed or constructed
on any lot. All homes must have a shingle roof.
Siding shall be masonry, wood or vinyl.
b. Minimum Residence Size: The heated
floor area of any home exclusive of porches,
carports, garages, basements and attics shall
not have less than fourteen hundred (1400) square
feet.
c. Underpinning: Homes must be underpinned within
thirty (30) days of occupancy. The type of material
shall be stucco over block or brick veneer.
d. Setbacks: All homes shall be located as close
to the front setback line as practical, but in
no instance closer than the minimum setback of
sixty (60) feet.
e. Fencing: Approval in writing is required by
the Architectural Control Committee prior to
type and placement of fencing.
f. Landscaping: Each lot owner
must seed or sod the front and side yards, to
the rear foundation of the residence, and to
the side lines of each lot. Evergreen or flowering
shrubs must be planted across the front foundation
of each residence.
g. Driveways: All driveways must be concrete,
asphalt, or gravel.
h. Outbuildings, Sheds, Additions: All storage
buildings, room additions, carports, and added
structures, or additions of any type or nature
whatsoever shall be required to conform to minimum
county building code requirements.
i. Miscellaneous Outdoor Structures: Satellite
TV dishes shall be no larger in diameter that
three feet (perimeter size) and are allowed only
on the rear of the house. No exposed above ground
tanks will be permitted for the storage of fuel
except propane tanks.
j. Residential Use Only: No lot shall be used
except for residential purposes or Home Occupations.
k. Refuse: Disposal of trash, debris, stumps,
trees, etc. shall be the responsibility of the
Residence Lot owner.
m. Animals: No animals, livestock, poultry or
reptiles of any kind shall be raised, bred, or
kept on any lot except that dogs, cats and other
household pets of a non-feral nature may be kept
provided that they are not bred or maintained
for any commercial purposes.
n. Nuisances: No noxious or offensive activity
shall be carried on upon any Lot, nor shall anything
be done thereon which may be or become an annoyance
or nuisance to the neighborhood. constantly barking
dog or roaming cats are considered a nuisance.
p. Vehicle Weight: No trucks, vehicles or other
conveyances shall be permitted on paved roads
in Marion Estates Subdivision with a gross weight
in excess of 58,000 lbs. without permission of
the Company.
q. Sewerage
Disposal: Individual sewerage disposal systems
(septic tanks) shall be permitted on all lots.
t. Condition of Lot: All lots shall be maintained
so that no weeds, underbrush or other unsightly
growths shall be permitted to grow or remain
upon the premises with the exception of undisturbed
buffer areas as designated on the plat of survey.
Under no circumstances shall any nonoperable
motor vehicle be allowed to remain on the premises
for more than twenty-four (24) hours.
Subdivision of Lots: None of the
lots on the recorded plat herinbefore set forth
shall at any time be divided into two or more lots
and offered for sale or lease.
